Mo’Kai’Ana L.L.C, Cypress, Texas (hereinafter referred to as “Mo’Kai’Ana Luxury Transport”) enables its users to book transportation services via its own online platform by integrating third-party online platforms (Website) (all methods collectively referred to as “Online Tools”)
Definitions
Welcome aboard to Mo’Kai’Ana Luxury Transport, a leading provider of Sprinter limousine and luxury black SUVs services in Cypress, Texas. This Terms and Conditions Agreement (“Agreement”) constitutes a binding agreement between you (“customer”) and Mo’Kai’Ana Luxury Transport for all transportation and related services. Completion of a reservation via www.mokaianalimo.com or through our office constitutes acceptance of this Agreement and registration as a Mo’Kai’Ana Luxury Transport traveler.
“Agreement” means these terms, the terms stated together with specific hire details stated. “Cancellation” means and cancellation by you, of our services, after we have accepted your booking. “Hire Period” means the period of time set out in a booking, or as amended by agreement, “Passenger” means and person who uses the services, or who enters the vehicle with the consent of another passenger, or of the person, or company booking our services “Price” means the price for the services set out in the booking. “Services” means the services of a Chauffeur driven vehicle. “Unacceptable Behavior” means any behavior considered to be unacceptable by the chauffeur including refusing to wear a seatbelt, leaning out of the window of the vehicle, standing out of the sunroof, attempting to exceed the maximum permitted number of passengers, smoking in the vehicle, being under the influence of excessive alcohol or under the influence of or in possession of any illegal substance, being violent aggressive or abusive, being a danger to himself or any other person, being excessively rowdy, provoking persons in the party to commit violent acts, or being in any way unfit to travel.
“Vehicle” means the vehicle stated at the time of booking, or a replacement vehicle, if for any reason the vehicle booked cannot be provided. “We/Us/Our” means Mo’Kai’Ana LLC “You/Your” means the individual or company making the booking.
In this agreement: Words denoting any gender include all genders and words denoting the singular include the plural and vice versa.
If there is any conflict between the booking and these terms, the provisions of the booking shall prevail.
Bookings and Cancellations
Our Cancellation Policy: We understand that plans can change. You can cancel your reservation without charge up for the full booking up to 8 days for Sprinter Limo and 24 hours for Black SUVs before your scheduled pickup time. However, cancellations or changes made within 24 hours of your pickup may be subject to charges.
Making Changes to Your Booking: Please note that last-minute changes to your pickup time may result in charges for both the original and the new time slot. For example, if you change your pickup from 2:00 PM to 4:00 PM with less than 24 hours’ notice (e.g., at 1:30 PM), you will be charged for both the 2:00 PM and 4:00 PM slots.
Peak Season and Special Events: During peak periods and special events, premium pricing, longer minimum rental times, and more restrictive cancellation policies may apply.
Accuracy of Information: The client is responsible for providing accurate information pertaining to the booking, including, but not limited to, pick-up and drop-off locations, and for ensuring that all members of their party are fully aware of and compliant with the company’s policies.
Passenger Conduct: The client and their guests are expected to conduct themselves in a respectful and lawful manner while utilizing the company’s services. Any damage to the vehicle or inappropriate behavior may result in additional charges or termination of the service, at the sole discretion of the company.
Prohibition of Smoking, Vaping, and Illegal Substances: Smoking and vaping of any kind, including, but not limited to, marijuana use, cigarettes, cigars, e-cigarettes, and vape pens, are strictly prohibited in all vehicles operated by the Company and its Affiliates. The use, possession, or distribution of any illegal substances, including, but not limited to, marijuana, narcotics, and controlled substances, is strictly prohibited in all vehicles operated by the Company and its Affiliates. The Company reserves the right to refuse service to any client or passenger found to be in violation of this policy. The Company further reserves the right to terminate service immediately if any client or passenger is found to be engaging in prohibited activities. In such event, the Company shall not be liable for any refund or reimbursement for unused service time.
Damage Charges: Clients shall be held financially responsible for any and all damage caused to the vehicle, including damage resulting from smoking, vaping, or the use of illegal substances. The costs associated with repairs or replacements necessitated by such damage will be assessed and billed to the client.
Agreement to Terms: Payment for the reservation and utilization of the Company’s services constitutes acknowledgement and acceptance of all Terms and Conditions listed herein, and agreement to be responsible for any associated charges incurred.

Office Hours and Response Times
If an email receives an “Out of Office” response, contact 281-990-5466 for immediate assistance.
Staff members are accessible during office hours, but urgent after-hours requests should be directed to the main office email or phone.
Performance of Services
Regarding Punctuality: We always strive to arrive on time. However, please understand that delays can occur due to circumstances beyond our control, such as traffic or weather. Unfortunately, we cannot issue refunds for delays caused by these unforeseen events.
Lost Items: While we are not responsible for personal belongings left in our vehicles, we will do our best to help you retrieve them.
Client Responsibilities: To ensure a pleasant experience for everyone, we reserve the right to refuse service to clients exhibiting disruptive behavior or possessing prohibited items. Alcohol and illegal substances are strictly prohibited for minors in our vehicles.
Cleaning and Damage: A minimum cleaning fee of $300 USD will be applied if the vehicle requires excessive cleaning due to mess or smoking. Clients will be responsible for the cost of repairing any damage they cause to the vehicle.
Compliance
Mo’Kai’Ana Luxury Transport’s policies regarding alcohol and illegal substances are strictly enforced. Consumption of alcohol by individuals under the age of 21 is strictly prohibited in accordance with applicable state and federal laws. The presence of contraband or illegal substances within our vehicles is prohibited. Chauffeurs are authorized to conduct searches of bags for illegal substances. The discovery of such substances will result in the immediate termination of the transportation contract, and the client will be solely responsible for securing alternate transportation arrangements. The carriage of glass containers of any kind is strictly prohibited in all fleet vehicles, absent express written authorization from the company Owner or CEO. Due to liability considerations, such authorization will typically not be granted.
Notwithstanding, Mo’Kai’Ana Luxury Transport will remain on-site with any minors until they are released to the custody of a parent, legal guardian, or other responsible adult. The full reservation fee, in addition to any accrued wait time charges, will be due and payable; no refunds will be issued. Furthermore, for safety considerations, travel on unpaved roads is strictly prohibited.
Chauffeurs retain ultimate discretion regarding route selection and are authorized to decline travel on roads deemed dangerous or excessively narrow. In instances where a designated pick-up or drop-off location is inaccessible via paved roadways, the customer shall be responsible for providing transportation to and from the designated vehicle location.
These policies are non-negotiable and binding.
Passenger Behavior
The client is responsible for the conduct of all passengers and for ensuring their understanding of the terms and conditions herein. Passengers must adhere to all safety regulations, including the use of seatbelts and refraining from leaning out of windows or standing through the sunroof. The client shall indemnify and hold harmless the company from any and all losses, costs, and expenses arising from the actions of any passenger. Smoking is strictly prohibited in all vehicles.
The company and its chauffeurs reserve the right to refuse entry or terminate service in the event of unacceptable passenger behavior. In such circumstances, the full contract price shall remain due and payable, and the company shall have no liability for any losses or costs incurred by the client. The client shall be liable for any and all damage to or loss of the vehicle or company property caused by any passenger, regardless of the manner in which such damage or loss is caused.
The client shall be responsible for the payment of all cleaning and valet costs necessitated by any spillage, sickness, or other action by a passenger that results in the vehicle’s cleanliness being of a lower standard than at the time of pickup.
Should the vehicle be rendered unfit for subsequent hire due to soiling or damage, the client shall be liable for a sum equivalent to the loss of hire fees, in addition to the replacement cost of any items removed or damaged from the vehicle.
In the event of any of the foregoing, the client hereby authorizes payment to be debited from the credit/debit card used to secure the booking, or agrees to immediate payment by other means, upon presentation of written/photographic evidence of damage or loss of subsequent hire fees.
The maximum seating capacity of the vehicle, as determined by the company, shall not be exceeded. The client is responsible for ensuring that all children or passengers under the height of 4’6” are secured in appropriate booster seats or child safety seats, as required by law.
Vehicles
While we shall endeavor to provide the vehicle type specified at the time of booking, we reserve the right to substitute an alternative vehicle should circumstances so require. In the unlikely event of a vehicle breakdown, we shall make all reasonable efforts to provide a replacement vehicle as expeditiously as possible. In the event that a replacement vehicle cannot be provided, a full refund of all hire fees paid shall be issued.
Luggage
All baggage and personal property shall remain the sole responsibility of the passenger at all times. The company shall not be held liable for any loss or damage to such baggage or personal property, regardless of the cause, whether occurring during transit or while left unattended in the vehicle.
It is the client’s responsibility to ascertain, at the time of booking, that the selected vehicle possesses adequate capacity and weight allowance to accommodate all luggage intended to be carried.
The company reserves the right to refuse carriage of luggage if, in the chauffeur’s reasonable judgment, the volume or weight thereof is deemed excessive.
Price of the Service
The price for the services shall be as specified in the booking confirmation, subject to amendment in accordance with the terms and conditions herein.
Where a fixed price has been agreed, it may be increased by an amount calculated in accordance with our standard hourly rate in effect at the time for any delay or extension of the agreed hire period arising from the following circumstances: (a) any delay attributable to the client or any passenger, regardless of cause; (b) any delay caused by severe traffic congestion, accidents, adverse weather conditions, or any other event or circumstance beyond our reasonable control; (c) delays in airport collections where flight delay information is reported only after the chauffeur has commenced the journey to the airport.
Any amounts due as a consequence of delays shall be added to and form part of the total price. Unless otherwise expressly agreed in writing, the stated price is exclusive of the following, which shall be payable in addition to the stated price, where applicable: [list items, e.g., tolls, parking, gratuity].
Pet travel: Pets are not permitted to roam freely within the vehicle; they must remain in carriers. Traveling with pet needs to be requested during booking (To ensure our drivers does not have an pet allergy).
Please note that gratuity is not included
A gratuity is not included in the price of your service. You are welcome to add a gratuity for your driver, either directly or when you make your reservation. While not required, it is up to the client discretion.
Terms of Payment
To confirm your reservation, we require a deposit unless you have a credit account with us or have arranged other payment terms when booking. Full payment is due before your trip (7 days for Sprinters and 48 hours for black SUVs). We accept Mastercard, Visa, Amex.
While we understand plans can change, please note that deposits are non-refundable. You are able to use your deposit from future reservations and base on availability. Reservations many not be future book during peak season unless PAID IN FULL.
If you have a credit account, please ensure payment within three weeks of the invoice date.
Waiting Time: We understand that travel plans can sometimes change. For airport pickups, we offer a 60-minute grace period after your flight arrives.
After that, waiting time will be billed at the vehicle’s hourly rate. For all other transfers, we provide a 15-minute grace period before waiting time charges apply.
Extra Stops: Need to make an extra stop? Each additional stop is $25 USD and includes up to 10 minutes of waiting time.
Meet & Greet Service: Our Meet & Greet service is complimentary for all airport arrival pickups.
Vehicle Damage and Cleaning Fees
The purchaser’s agreement signifies their acceptance of full liability for all charges.
To ensure the safety and cleanliness of our fleet, and to maintain a pleasant experience for all our clients, the following fees will apply for damage or excessive cleaning:
- Food and Drink: Food and snacks are not permitted in our vehicles unless written approval is granted by management 24 hours prior to your reservation.
- Alcohol Spills: A minimum cleaning fee of $300.00 will be charged for any alcohol spill on vehicle seats.
- Carpet Damage: A minimum cleaning/repair fee of $200.00 will be charged for damaged carpets.
- Mirror Damage (Limousines): A minimum replacement fee of $500.00 per damaged mirror will be charged.
- TV Monitor Damage: A minimum replacement fee of $700.00, plus repair labor and out-of-service fees, will be charged for damage to flat-screen TV monitors.
- Extensive Cleaning: A minimum cleaning fee of $250.00 will be applied for extensive cleanups (e.g., spills of soda, wine, or other liquids; food cleanup).
- Gum Removal: A $100.00 fee will be charged for gum removal from carpets.
- Interior Soiling (Sickness): A minimum shampooing and disinfecting fee of $1,000.00 will be charged for interior soiling due to sickness.
- Exterior Detailing (Sickness): A $350.00 detailing and wax fee will be charged for exterior cleaning due to sickness.
- Seat Damage: A minimum fee of $500.00 will be charged for damaged seats, pending a repair estimate.
- Broken Glassware: A $75.00 fee will be charged for broken glassware.
- Upholstery Damage: A $500.00 fee will be charged for rips or tears to upholstery.
- Vandalism: A minimum fee of $750.00 will be charged for each act of vandalism (including, but not limited to, damage to TV/stereo equipment).
- Sprinter Van Table Damage: Scratches to the Sprinter van table will result in a minimum $900.00 replacement fee plus labor. Please allow your chauffeur to assist with items brought onboard to avoid scratch charges.
- Smoking: Smoking in any of our vehicles will result in a $750.00 fee, and the reservation will be terminated immediately upon the first incident.
- Client Cleaning: Clients are not permitted to clean our vehicles due to insurance and liability reasons.
- Door Damage: A minimum fee of $1,000.00 will be charged for opening a vehicle door into another vehicle or stationary object. Please allow your chauffeur to open your door.
- Incited Damage: Clients are responsible for any damage caused by their actions, including inciting others to damage the vehicle (e.g., yelling insults at pedestrians).
General Damage Policy:
This list is not exhaustive. Damages to our vehicles (including Sedans, SUVs, Sprinter vans, and buses) will be assessed, and the responsible client will be provided with an estimate. All damages to our vehicles or affiliate vehicles are covered by this agreement. This includes (but is not limited to) loss of revenue due to downtime for repairs, which will be charged to the client’s credit card on file. If the client’s credit card does not have sufficient funds to cover the total costs of repairs and company losses (including affiliates), we reserve the right to pursue legal action to recover all losses, including court costs and company time.

Warranties, Liability, and Guarantee
While we do our best to accommodate overtime requests on hourly rentals, we cannot guarantee it. To avoid any issues, please plan your schedule carefully and allow for potential delays. If you need to change your itinerary, please let us know, and we’ll do our best to accommodate you, depending on other bookings. You are responsible for any extra costs incurred, such as overtime, tolls, and parking, and you authorize us to charge these to your card on file or direct bill account.
We regularly inspect our vehicles to ensure they meet our high standards, and we will provide the vehicle you booked whenever possible. In the unlikely event of an emergency (like a breakdown or accident), we may need to upgrade or substitute your vehicle. Upgrades are always complimentary. We appreciate your understanding that we cannot be held responsible for delays or changes caused by events beyond our control, such as weather, traffic, accidents, or flight delays. We will, of course, do our best to keep you informed of any such situations.
We warrant that the services provided hereunder will be performed with reasonable care and skill.
Our total liability to you arising out of or in connection with these services shall be limited to the lesser of the price paid by you for such services or the amount actually received by us from you for such services. We shall not be liable to you for any loss of profits, goodwill, reputation, business contracts, revenue, production, anticipated savings, or losses arising from third-party claims in connection with the services. Furthermore, we shall have no liability to you for any indirect, special, or consequential loss, damage, costs, or expenses, including, but not limited to, labor costs or the cost of hiring a replacement vehicle.
Resolving Disputes: We hope you’ll be happy with our services. However, if any disagreements arise, they will be handled through binding arbitration in Houston, Texas, following the rules of the American Arbitration Association.
Modification of Terms: We reserve the right, in our sole discretion, to modify these Terms at any time and without prior notice. Notice of such modifications shall be provided by posting the revised Terms on our website with an updated effective date. Continued use of our services following the posting of such revised Terms shall constitute your acceptance of the modified Terms.
Miscellaneous
We reserve the right to subcontract, assign, or otherwise transfer our obligations and rights under this agreement, in whole or in part, to a competent third party or any associated company. You may not assign or transfer any of your rights or obligations arising under this agreement without our express written consent.
